1. Agreement to Terms

By accessing our website at mccormicklandscaping.com or engaging our landscaping services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

2. Service Description

McCormick Landscaping provides professional landscaping services including but not limited to:

• Landscape design and installation
• Lawn care and maintenance
• Irrigation system installation and maintenance
• Hardscaping (patios, walkways, retaining walls)
• Outdoor lighting installation
• Seasonal cleanup services
• Tree and shrub care
• Commercial landscaping services

3. Estimates and Pricing

All estimates provided are based on site visits and assessments at the time of inspection. Final pricing may vary based on:

• Changes to project scope
• Unforeseen site conditions
• Material availability and pricing changes
• Weather conditions affecting project timeline

Estimates are valid for 30 days from the date of issue. We will notify you of any significant price changes before proceeding with work.

4. Payment Terms

For Projects Over $5,000

• 50% deposit required upon contract signing
• 25% due at project midpoint
• 25% balance due upon project completion

For Projects Under $5,000

• Full payment due upon completion
• For maintenance services: payment due upon service completion or monthly billing available

Accepted payment methods include check, cash, and major credit cards. Late payments may incur a 1.5% monthly finance charge.

5. Project Timeline

We will provide an estimated timeline for project completion. However, completion dates are approximate and may be affected by:

• Weather conditions
• Material delivery delays
• Unforeseen site conditions
• Client-requested changes

We will communicate any delays promptly and work to minimize disruptions.

6. Cancellation Policy

Client Cancellation: Projects may be cancelled with written notice. Deposits are non-refundable, and you will be billed for work completed and materials purchased up to the cancellation date.

Our Cancellation: We reserve the right to cancel or refuse service at our discretion with full refund of any deposits paid.

7. Warranties and Guarantees

Workmanship Warranty

We guarantee our workmanship for one year from project completion. This warranty covers defects in installation and construction but does not cover:

• Normal wear and tear
• Damage from extreme weather or acts of nature
• Damage caused by client or third parties
• Lack of proper maintenance

Plant Warranty

Plants are guaranteed for 60 days from installation, provided proper watering and care instructions are followed. Extended warranties available upon request.

8. Client Responsibilities

The client agrees to:

• Provide accurate information about property boundaries and utility locations
• Obtain necessary permits (unless otherwise agreed in writing)
• Ensure clear access to work areas
• Secure pets during service visits
• Mark or identify any underground utilities, sprinkler lines, or lighting cables
• Follow care and maintenance instructions provided

9. Liability and Insurance

McCormick Landscaping carries general liability insurance and workers' compensation insurance. We are not responsible for:

• Damage to unmarked underground utilities
• Pre-existing conditions or defects not disclosed
• Damage caused by client or third parties after project completion
• Plant loss due to improper watering or care

10. Changes to Scope of Work

Any changes to the agreed-upon scope of work must be documented in writing and may result in additional charges. Change orders must be approved by both parties before proceeding.

11. Dispute Resolution

Any disputes arising from these terms or our services will first be addressed through good faith negotiation. If resolution cannot be reached, disputes will be resolved through binding arbitration in Multnomah County, Oregon, in accordance with Oregon law.

12. Limitation of Liability

Our liability for any claim arising from our services is limited to the amount paid for the specific service that gave rise to the claim. We are not liable for indirect, incidental, or consequential damages.

13. Intellectual Property

All landscape designs, plans, and drawings created by McCormick Landscaping remain our intellectual property unless otherwise agreed in writing. Clients may not reproduce or use these designs without our express written consent.

14. Photography and Marketing

We may photograph completed projects for portfolio and marketing purposes. By engaging our services, you grant us permission to photograph and use images of your property in our marketing materials unless you specifically request otherwise in writing.

15. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms of Service will otherwise remain in full force and effect.

16. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified terms.
